Respondents Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus directing the respondents to survey the land and fix the boundary stones in S.F.No.30/2 to an extent of 29.26 Ares (Patta No.2253), Muthalipalayam Village, Tiruppur District based on petitioner's online application No.2025/0123/32/ 005392 dated 24/07/2025 by appreciating the above stated facts. ORDER
This writ petition has been filed seeking issuance of a writ of mandamus directing the respondents 1 and 2 to deal with the application submitted by the petitioner on 24.07.2025 wherein the petitioner is seeking for survey of the subject property and fixing of boundary stones.
2. Heard Mr.V.Anandhamoorthy, learned counsel for petitioner and Mr.P.Ganesan, learned Government Advocate appearing for respondents.
3. The case of the petitioner is that he is one of the joint owner of the subject property to an extent of 29.26 Ares. This property was purchased by the petitioner jointly with Balasubramaniam and Eswaramoorthy through a sale deed dated 24.05.2011, which was registered as document No.2096 of 2011. The petitioner and the other coowners were in possession and enjoyment of the property and a joint patta was also issued in Patta No.2253.
4. The petitioner submitted an application on 24.07.2025 seeking for survey of the subject property and for fixing the boundary stones. Since the same was not acted upon, the present writ petition has 2/4
been filed.
5. Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction to the respondents to act upon the petitioner's online application dated 24.07.2025 and conduct survey in the subject property based on the title document and the joint patta that has already been issued. If there are any other interested parties, such survey shall be conducted in their presence. The said process shall be completed within a period of four (4) weeks from the date of receipt of a copy of this order. This writ petition is disposed of with the above direction. No costs.
