No 1, 2 and 5 of the Tender Notice i.e. totally 3 works (Thiruvallur (H) C & M Division (Re-Call) on the file of the 1st respondent.

ORDER
This Writ Petition has been filed seeking for a Writ of Mandamus, directing the respondents to conduct re-inspection of plant and machinery of the petitioner and reissue the proper working conditions of plant and machinery certificates as per the rectification application of the dated 13.10.2025 (through RPAD and e-mail) in order to submit his bids through online on or before 16.10.2025, 10.15 Hrs in Tender Notification in Tender Notice No.50/ 2025 - 2026 / HDO dated 20.9.2025 in respect of works in S. No 1, 2 and 5 of the Tender Notice i.e. totally 3 works (Thiruvallur (H) C & M Division (Re-Call) on the file of the 1st respondent.
2.The case of the petitioner is that he is a Class-I Contractor under the Highways Department and intended to participate in the e-tender notified by the first respondent in Tender Notice No.50/2025-2026/HD and to submit his bids by 10.15 hours. It is the further case of the petitioner that as per one of the conditions of the tender notification, the petitioner/tenderer had to obtain Work Site Inspection Certificate and working condition of the Plants & Machineries Certificate from the concerned Divisional Engineer, (H) (C&M) before 09.10.2025 up to 17.45 Hrs and the last date for receipt of the said certificates from the concerned Divisional Engineer (H)(C&M) is on or before 15.10.2025 before 17.45 Hrs.
3.The further case of the petitioner is that though the respondents have issued the Work Site Inspection Certificate and working condition of the Plants & Machineries Certificate to the petitioner, the respondents have observed in the Working Condition Certificate that certain machines were not working. The petitioner has now filed this Writ Petition for a direction to the respondent for re-inspection of plant and machinery of the petitioner and to reissue the proper
working conditions of plant and machinery certificates as per the rectification application of the dated 13.10.2025 (through RPAD and e-mail) in order to submit his bids through online on or before 16.10.2025, 10.15 Hrs. 4.The learned counsel for the petitioner submitted that the machines of the petitioner have since been repaired and they are in good condition and hence, a direction may be issued to the respondent to re-inspect the plant and machinery of the petitioner and to reissue the proper working conditions of plant and machinery certificates.
5.Heard the learned counsel for the petitioner and learned Special Government Pleader appearing for the respondents and perused the materials available on record.
6.Considering the facts and circumstances of the case, the respondents are now directed to re-inspect the plant and machinery of the petitioner on or before 15.10.2025, before 05.00 p.m. and to consider for issuance of fresh plant and
machinary certificate to the petitioner to enable him to submit his bids through online on or before 16.10.2025, 10.15 Hrs.
