O R D E R
The present Criminal Original Petition has been filed seeking a direction to the respondents not to harass the petitioner under the guise of enquiry.
Learned counsel appearing for the petitioner submitted that the petitioner was earlier arrested and released on bail and has been regularly complying with the conditions imposed by the Court. However, the respondent Police, under the pretext of conducting an enquiry, are unnecessarily harassing the petitioner.
Learned Government Advocate (Criminal Side), on instructions, submitted that the petitioner is a habitual offender, against whom seven previous cases are pending. He further submitted that the petitioner was convicted in a murder case and after his release, has been indulging in the sale of lottery tickets. He further submitted that the petitioner was recently arrested in Crime No.508 of 2025, registered on the file of the fourth respondent, and was subsequently enlarged on bail and has been complying with the conditions. Police are not harassing the petitioner and are only proceeding against him in accordance with law. He further submitted that there is an information that the petitioner is again illegally involved in selling lottery tickets and that the present petition has been filed in a pre-emptive manner. Heard both sides and perused the materials available on record.

It is the case of the respondents that only on the information that the petitioner is habitually involved in the sale of lottery tickets, he has been called for enquiry.

It is made clear that if any case is registered against the petitioner, the respondents are at liberty to proceed in accordance with law. However, without any case being registered, the petitioner cannot be unnecessarily harassed.

With the above observation, this Criminal Original Petition stands closed.
