ORDER
The petitioners, who were arrested and remanded to judicial custody on 19.08.2025, for the offences punishable under Sections 61(2), 191(2), 191(3), 103(2) and 351(3) of BNS in Crime No.235 of 2025, registered on the file of the respondent police, seeks bail.

The case of the prosecution is that on account of an illicit relationship between Rahamathulla's/A3's wife and the deceased person, namely Sadiqbasha, the accused/A3 got enraged and therefore conspired with other accused persons to murder Sadiqbasha. On 18.08.2025, A1 and A2 taken Sadiqbasha to Koonimedu Beach, and they along with other accused, jointly murdered Sadiqbasha by attacking him by using various weapons. Hence, this case.

The learned counsel appearing for the petitioners submitted that the
petitioners have been falsely implicated in this cases and they are in judicial custody since 19.08.2025. He further submitted that the petitioners are ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioners.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioners, reiterated the prosecution case and states that there are totally five accused in this case and based on the instigation of A3, the petitioners along with other accused had murdered the deceased; and that the investigation is pending. 5.
Considering the facts, the gravity of the offence, the allegation against the petitioners, and the fact that the investigation is pending, this Court is not inclined to grant bail to the petitioners. 6.
