Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the financial controller, Directorate of School Education, the 1st Respondent herein, to pass orders on the representation dated 05.12.2022 in accordance with law rectifying the pay anomaly between the 1/4
petitioner and his junior by stepping up the salary of the petitioner on par with that of his junior based on the particulars given by the Headmaster, Enusonai Government Higher Secondary School, Krishnagiri District, the 3rd Respondent herein, in Form 1 and 2 relating to the service records of the petitioner and his Junior by following the judgements dated 25.02.2022 in W.P. No.573 of 2015 and W.P. No.11744 of 2023 dated 21.08.2024 passed by this Honble Court in similar circumstances within a time frame to be fixed by this Honble court. ORDER
This Writ Petition has been filed seeking a direction to the respondents to consider the representation submitted by the petitioner for rectification of the pay anomaly between the petitioner and his junior, by stepping up the salary to the petitioner on par with that of his junior.
2. Heard the learned counsel appearing on either side and perused the materials available on record.
3. On a perusal of the records, it is seen that, on receipt of the 2/4
representation, the petitioner was called upon to submit the relevant documents. Accordingly, the petitioner submitted all the required documents and the same is pending on the file of the first respondent for consideration.
4. In view of the above, without expressing any opinion on the merits of the writ petition, the first respondent is directed to consider the representation submitted by the petitioner seeking rectification of pay anomaly between the petitioner and his junior, by stepping up the salary to the petitioner on par with that of his junior, and pass appropriate orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.
5. With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
