The present Writ Petition (Criminal) has been filed seeking a direction to the respondents to provide adequate police protection to the petitioner to fence his property, based on his representation dated 24.03.2025.
Learned counsel appearing for the petitioner submitted that the petitioner, aged about 74 years, is the owner of the land comprised in R.S.Nos.389/9, 385/7 and 385/8, situated at Keezhur Village, Kurinjipadi Taluk, Cuddalore District and that he has been carrying on agricultural activities in the said land. He further submitted that the neighbouring land owner, one Paavadai, has been creating problems whenever the petitioner attempts to fence his land. Hence, the petitioner lodged complaints before the third respondent on 11.12.2023 and 16.04.2024, for which CSR Nos.871 of 2023 and 176 of 2024 were registered. However, since there was no progress thereafter, the petitioner had once again sent a 2/5
representation dated 24.03.2025 to the respondents. As no action was taken on the said representation, the present petition has been filed. Learned Additional Public Prosecutor appearing for the respondent Police submitted that based on the complaints given by the petitioner, the enquiries were conducted in C.S.R.Nos.871 of 2023 and 176 of 2024. During the course of enquiry, it was found that there exists a boundary dispute between the petitioner and his adjacent land owner. Since the dispute between the parties is civil in nature, the petitioner was advised to approach the civil Court for appropriate relief. 4.
Heard both sides and perused the materials available on record.

In view of the above, this Court is of the opinion that the relief sought by the petitioner cannot be granted, as a civil dispute is pending between the petitioner and his adjacent land owner. However, the petitioner is directed to work out his remedy before the appropriate forum in the manner known to law.

Accordingly, this Writ Petition (Criminal) stands disposed of. No costs.
