ORDER

The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Section 21(1) of Mines and Minerals (Development & Regulations) Act, 1957, in Crime No.406 of 2025, on the file of the respondent police, seeks anticipatory bail. 2.This is the second anticipatory bail application. The case of the prosecution is that the petitioner had illegally quarried 9 cubic meters of gravel in a lorry from public place. Hence, the case. 3.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and has been falsely implicated in this case. The petitioner is ready and willing to abide by any conditions that may be imposed by this Court hence, he prays to grant anticipatory bail to the petitioner, on the ground that investigation is pending.

4.The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and opposed the grant of anticipatory bail to the petitioner.

5.Considering the gravity of the offences, and though vehicles seized, quantity involved is very high, and the petitioner damaged the ecology, if granted bail they will indulge in similar offences, this Court is not inclined to grant bail to the petitioners and there is no change in circumstances of the case.
