ORDER

This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 25.09.2025, seeking bail in Crime No.458 of 2025, registered for the offence punishable under Sections 8(c) and Section 20(b)(ii)(C ) of Narcotic Drugs Psychotropic Substances Act,

The allegation against the petitioner is that on 25.09.2025, based on the secret information, the respondent police intercepted a Tata Sumo vehicle bearing Reg.No.AP-02-BA-4782 and at that time, they found the petitioner along with other accused in possession of 100 Kgs of ganga. Hence, the case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He has not committed any offence as alleged in the FIR. He further submitted that the petitioner is in custody from 25.09.2025 and the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, the learned counsel prays for grant of bail to the petitioner.

Learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution's case and on instruction submitted that the respondent police seized 100 kgs of ganga and Tata Sumo vehicle bearing Reg.No.AP-02, BA 4782, from the accused and seized contraband is commercial quantity and it requires satisfaction the twin conditions as contemplated under Section 37 of NDPS Act. Hence, he vehemently opposed for grant of bail to the petitiner.

Considering the representation made by both side counsel and the huge quantity of contraband involved in this case which is a commercial quantity and that the petitioner has not satisfied the twin conditions required under Section 37 of NDPS Act, I am not inclined to grant the bail to the petitioner.
