PRAYER to call for the records connected with the impugned regularisation order No.17314/1020252124/PPA/Z/(individual/plot)/2025 dated 30.6.2025 issued by the 2nd respondent and quash the same and direct the 3rd respondent not to register any Sale deeds with regard to any plots in Ganabathi Nagar, in RS.No.175/37,Veerampattinam village, with Patta No.660, in Ariyankuppam Revenue village, Ariyankuppam panchayat within Puducherry Sub Registration District and Registration District.

Mr. A.Tamilvanan, learned Additional Government Pleader (P) takes notice for R1, R2, R3 and R7.

2. Though the issue presented is one of regularization, the records shows that the title of the writ petitioner is in dispute.

3. As pointed out by Mr.Tamilvanan, the writ petitioner has already approached the jurisdictional Civil Court by way of a suit for permanent injunction against the 5th respondent herein as the sole defendant.

4. This suit had been presented on 01.08.2025. At the time, when the suit was presented, it transpires that the petitioner was not aware of the order of regularization. As the holdings of the petitioner has been demarcated as road, it causes a cloud over his title.

5. In such circumstances, the better remedy available to the petitioner is to move the jurisdictional Civil Court seeking for declaration of his title with consequential relief of injunction.

6. A probe on may not be appropriate under Article 226 of the Constitution of India.

7. Taking into consideration the plea of Mr.M.S.Krishnan that the petitioner might be dispossessed at any moment, I am inclined to order of status quo for a period of four weeks from today to enable the petitioner to move the Civil Court as aforesaid.

8. With the above relief of status quo, the writ petition stands dismissed. No costs. Consequently, connected miscellaneous petitions are closed. 24-11-2025 Index:Yes/No Speaking/Non-speaking order Internet:Yes Maya
