PRAYER :Civil Revision Petition filed Article 227 of Constitution of India, praying to expedite the trial and speedy disposal of O.S.No.123 of 2024 on the file of District Munsif Court at Dharapuram filed under order VII Rule 1 of CPC.

ORDER

The Civil Revision Petition is filed seeking expeditious disposal of the suit in OS.No. 123 of 2024 on the file of District Munsif Court at Dharapuram. 1/4

2. The petitioners herein filed a suit for ejectment and also for recovery of outstanding arrears of rent.

3. The respondent herein filed written statement as early as 16-12-2024.

4. When the Civil Revision Petition came up earlier, this court called for remarks from the trial court. A perusal of the remarks submitted by the trial court would indicate that two applications in IA.No.3 of 2024 and IA.No.4 of 2024 are pending and hence, the suit is not taken up for trial.

5. The I.A.No.3 of 2024 has been filed by the petitioners herein seeking injunction restraining the defendant from interfering with his right to repair and carry out painting work in the suit property. IA.No.4 of 2024 has been filed by the respondent restraining the petitioners from disconnecting essential water supply and other amenities to the suit property.

6. In view of the same, the Trial Court is directed to dispose of the IA.Nos.3 and 4 of 2024 as expeditiously as possible. After disposal of IA's, the suit shall be taken up for hearing and disposed of. 2/4

7. With the direction, the civil revision petition stands disposed of. No costs.
