ORDER

This writ petition has been filed for the issue of a writ of mandamus direction the 1st respondent to consider the representation made by the petitioner dated 25.8.2022 and to pass orders within time frame fixed by this Court.

2.Heard Mr.R.Ravindra Ram, learned counsel for the petitioner and Mr.D.Ravichander, learned Special Government Pleader for R1. 3.The grievance of the petitioner is that the patta has been transferred in the name of third parties who do not have any right or title over the property. Therefore, the petitioner submitted an application before the Tahsildar and the same was rejected by proceedings dated 23.08.2021. Thereafter, the petitioner has submitted a representation before the 1st respondent and since the same was

not considered the present writ petition has been filed before this Court.

4. In the considered view of this Court, the 1st respondent is not the Appellate Authority under the Patta Passbook Act, 1983. If the Tahsildar has rejected the application submitted by the petitioner, the petitioner can only file an appeal before the RDO.

5.In view of the above, it is left open to the petitioner to file a representation before the concerned RDO with all the relevant documents and on receipt of the same, the RDO shall deal with the same on its own merits and in accordance with law, after affording opportunity to the petitioner and the 2nd respondent and pass final orders as expeditiously as possible.
