This writ petition has been filed for direction to the 2nd respondent to survey the lands in survey numbers 33/3A in 36 cents in Chakarachettipatti Village at Omalur Sub Registrar, Salem west district registrar of the petitioner's properties.

Heard the learned counsel appearing on either side and perused all the materials placed before this Court. 3.

On instruction, the learned Government Advocate appearing for the respondents submitted that without even partition of the subject land, the petitioner alone is now seeking to survey, which is not permissible since the entire land is enjoyed by various parties concerned. 4.

Therefore, the representation of the petitioner cannot be considered. As such, this writ petition is liable to be dismissed. However, after sub division of the subject property as per partition, the petitioner can very well seek to survey the said land.

With the above direction, this writ petition is dismissed. There shall be no order as to costs.
