PRAYER The Writ Petition is filed under Article 226 of the Constitution of India to extend the ordinary leave for 30 days with out escort from 16.10.2025 in W.P.Crl.No.373 of 2025 and W.P.Crl.175 of 2025 to the detenue, Soundararajan S/o. Sivanmani, aged about 41 years, PID No.37810, confined at Central Prison, Coimbatore.

ORDER
(Order of the Court was made by N.SATHISH KUMAR, J.) This Writ Petition has been filed seeking ordinary leave to his son / convict namely, Soundararajan, aged about 41 years, PID No.37810, confined at Central Prison, Coimbatore.
2. It is the case of the petitioner that his son is undergoing Life Sentence and has completed 10 years of imprisonment. Till now, he has not availed the entire ordinary leave except six days which was already granted by this Court, vide order dated 07.10.2025.
3. The learned counsel for the petitioner submits that under Rule 22 of the Tamil Nadu Suspension of Sentence Rules, 1982, the petitioner, who completed 10 years of imprisonment, is entitled to 28 days ordinary leave, whereas he has availed only six days.
4. The learned Additional Public Prosecutor submits that this Court, vide order dated 07.10.2025, granted six days ordinary leave to the convict with minimum escort and the convict has returned back to the prison on expiry of leave on 16.10.2025. He further submits that no adverse case whatsoever was brought against the convict by the Police.

Considering the fact that the life convict has availed only six days ordinary leave and as per Rule 22 of the Tamil Nadu Suspension of Sentence Rules, 1982, a prisoner, who completed 10 years of imprisonment, is entitled to 28 days ordinary leave, we are inclined to extend the leave for remaining period of 22 days to the convict. Accordingly, the convict viz., Soundararajan, S/o.Sivamani,Convict PID No. 37810, confined at Central Prison, Coimbatore, is hereby granted ordinary leave for a period of 22 days, without escort, commencing from 28.10.2025 to 18.11.2025. The convict shall be released from the prison at 10.00 a.m on 28.10.2025 and he shall return back to the prison on or before 05.00 p.m. During the period of leave, the prisoner shall report before the Inspector of Police, Kangeyam Police Station, on every day at 05.00 p.m. The Convict Prisoner shall utilize the leave only for the ground on which it has been granted and shall not indulge in any other illegal activities.
