The petitioner herein apprehends arrest at the hands of the respondent police for the offence punishable under Sections 275 and 123 of the Bharatiya 1/4

Nyaya Sanhita 2023, read with Section 24(1) of the Cigarette and other Tobacco Products Act, 2003 (COTPA), in Crime No.513 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused were found to be in illegal possession of 2.4 kg of ganja. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and has been falsely implicated in this case. The petitioner is ready and willing to abide by any conditions that may be imposed by this Court hence, he prays to grant anticipatory bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and opposed the grant of bail to the petitioner on the ground that the petitioner is involved in 7 previous cases.

5. Heard the learned counsels on either side and perused the materials available on record.

6. Considering the nature of the allegations and the fact that the petitioner was found in illegal possession of 2.4 kg of tobacco products and has bad antecedents, this Court is not inclined to grant anticipatory bail to the petitioner.
