Mr.V.Prakash Senior Counsel for Mr.G.D.Sendillveal for R1 Ms.J.R.Archana Government Advocate (Crl.Side) for R2 COMMON ORDER This contempt petition has been filed to punish the respondent for his wilful disobedience and non-compliance of the order of this Court, dated 09.07.2025, made in Crl.R.C.No.1011 of 2025, thereby, setting aside the order passed in Crl.M.P.No.146 of 2025, on the file of the Judicial Magistrate No.II,

3/6 Jayankondam, Ariyalur District.

2.Crl.M.P.No.20235 of 2025 is filed to clarify the order passed in Crl.R.C.No.1011 of 2025, dated 09.07.2025.

3.The petitioner herein is one of the accused in Crime No.3 of 2019, on the file of the Inspector of Police, District Crime Branch, Ariyalur District, on the complaint lodged by the first respondent herein. After completion of investigation, final report was filed, thereby, the respondent police have closed the FIR as 'mistake of fact' and that the allegations levelled against the petitioner are civil in nature and civil suit is also pending. 4.Aggrieved by the same, the first respondent herein filed a protest petition in Crl.M.P.No.146 of 2025, on the file of the learned Judicial Magistrate No.II, Jayankondam, Ariyalur District. The learned Judicial Magistrate allowed the protest petition and ordered for further investigation in Crime No.3 of 2019. Aggrieved by the same, the petitioner herein preferred Crl.R.C.No.1011 of 2025 and the same was allowed by this Court, vide order dated 09.07.2025, thereby setting aside the order passed in Crl.M.P.No.146 of 2025, on the file of the

4/6 learned Judicial Magistrate No.II, Jayankondam, Ariyalur District. 5.The complication arose for disobedience of the order passed by this Court and that there are three complainants in the same complaint, i.e., father, son and his wife. A complaint cannot be lodged by more than one person, therefore, the respondent police had rightly registered the FIR in Crime No.3 of 2019, on the complaint lodged by the first respondent herein. Thereafter, final report had been filed and the FIR was closed. The other complainants also filed protest petitions in Crl.M.P.Nos.144 & 145 of 2025. The learned Judicial Magistrate rightly closed Crl.M.P.Nos.144 & 145 of 2025 and allowed Crl.M.P.No.146 of 2025 and ordered for further investigation in Crime No.3 of 2019. Since there cannot be three complaints, Crl.M.P.Nos.

144 & 145 of 2025 had been merged with Crl.M.P.No.146 of 2025. Though the petitioners in Crl.M.P.Nos.144 & 145 of 2025 are victims, only one FIR was registered in Crime No.3 of 2019. Therefore, the respondent police issued summons to the petitioner herein for investigation purpose in Crime No.3 of 2019. Hence, the respondent police should not have issued any summons since earlier final report was filed in Crime No.3 of 2019 and Crime No.

5/6 per the order dated 09.07.2025, passed by this Court in Crl.R.C.No.1011 of 2025. Hence, the summons dated 24.09.2025 issued by the respondent police cannot be sustained and it is liable to be set aside. 6.In view of the above, the order passed in Crl.R.C.No.1011 of 2025 is clarified accordingly and the contempt petition is also closed. 12-11-2025 Index:Yes/No Speaking/Non-speaking order Internet:Yes sli To 1.The Deputy Superintendent of Police, 2.The Inspector of Police, Ariyalur District.
