ORDER

The petitioner, who was arrested and remanded to judicial custody on 01.09.2025, for the offences punishable under Sections 309(4), 311 and 351(3) of BNS Act,2023 in Crime.No. 366 of 2025 on the file of respondent police, seeks bail.

2. The case of the prosecution is that on 31.08.2025 at about 09.30 p.m., when the defacto complainant was standing near Kaliyamman Temple situated in his residing area, the petitioner demanded money from the defacto complainant for consuming liquor, when the defacto complainant refused to give money, the petitioner at knife point snatched a sum of Rs.1,000/- from him and also threatened him with dire consequences. Hence, the case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and has been falsely implicated in this case. He further submitted that the petitioner has been in custody from 01.09.2025 and prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Criminal side) appearing for the respondent police, reported that the petitioner had robbed a sum of Rs.1,000/-

from the defacto complainant at knife point and had 4 previous cases against him. Hence, he strongly opposed to grant bail to the petitioner.

5. Considering the above facts and circumstances of the case, taking note of the submissions made by the learned Government Advocate (Crl.Side), considering the fact that the petitioner has bad antecedents and the investigation in this case is not concluded, this Court is not inclined to grant bail to the petitioner.
