ORDER
The petitioners herein, who were arrested and remanded to judicial custody on 08.10.2025 for the offences punishable under Sections 123 of BNS r/w. Section 24(1) of COTPA Act in Crime No.418 of 2025, registered on the file of the respondent police, seek bail. 2.
The case of the prosecution is that the petitioners were found in illegal transportation of banned tobacco products namely Hans @ Gutka - 800 packets (1 packet contains 15 pouch = 12,000 pouch), Vimal - 200 packets (1 packet contains 30 pouch = 6,000 pouch), V1 Tobacco - 200 packets (1 packet contains 30 pouch = 6,000 pouch), total weighing 246.600 kilograms in a car bearing Registration No.TN-22-CC-2939 for the purpose of illegal sales. Hence this case.

The learned counsel appearing for the petitioners submitted that the petitioners have been falsely implicated in this case and they were in judicial custody since 08.10.2025. He further submitted that the petitioners are ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioners. 2/4

The learned Government Advocate (Criminal Side) appearing for the respondent police while opposing the bail to the petitioners, reiterated the prosecution case and stated that the petitioner/ Muthulingam is having 7 previous cases and the petitioner/ Egambaram has no previous antecedents; that the total quantity of contraband involved in this case is 246.600 kilograms of banned tobacco products; and that the investigation of this case is pending.

Considering the facts, gravity of offence, the quantity of contraband involved in this case and taking note of the fact that the investigation of this case is pending, this Court is not inclined to grant bail to the petitioners.

Accordingly, these criminal original petitions stand dismissed. 17.10.2025 stn 3/4
