ORDER

The petitioner, who was arrested and remanded to judicial custody on 06.08.2025 based on execution of NBW dated 30.07.2025 in S.C.No.185 of 2022 pending trial on the file of the learned III Additional District and Sessions Judge, Dharapuram for the offences punishable under Sections 342, 114, 109, 120(b), 147, 148, 302 IPC and 83(2) JJP Act, seeks bail. The earlier bail application of the petitioner was dismissed by this Court, vide order dated 22.09.2025 in Crl.O.P.No.26032 of 2025 by observing as follows:

"The petitioner earlier moved a bail petition in Crl.O.P.No.24041 of 2025 dated 02.09.2025 and this Court by recording the submission of the learned Government Advocate (Crl. Side) and also the order of the Trial Court that the petitioner is a habitual offender and the Non-Bailable Warrant was issued and executed and it has been recorded by the Trial Court that this is a third occasion, the petitioner has jumped bail and since there is no change in circumstances after dismissal of the earlier bail petition, this Court is not inclined to grant bail to the petitioner."

Heard the learned counsel appearing for the petitioner. 3.

The learned Government Advocate (Crl. Side) appearing for the respondent submitted that there are totally 13 accused and the petitioner is arrayed as A8 and the case is posted for cross examination of P.W.1 on 2/4

11.11.2025 and the trial is progressing.

Considering the fact that the trial is progressing and the present bail petition is filed without any change of circumstances after the dismissal of the earlier bail application in Crl.O.P.No.26032 of 2025, this Court is not inclined to grant bail to the petitioner. 5.
