O R D E R
The petitioner came forward with the grievance that despite possessing necessary licences which are valid as on today, the officials belonging to the Greater Chennai Corporation had called upon the petitioner to close down his business. Taking note of the submissions, I directed Mr.Arunbabu, Standing Counsel for the Greater Chennai Corporation to get instructions and to submit a report to this Court.
2. When the matter was called today, Mr.Arunbabu reports that Block No.11, Town S.No.141 [Part] to an extent of 94.5 sq.mts of Thiruvanmiyur Village has been encroached by the writ petitioner. Apart from the writ petitioner, the notice also states that the following persons, namely, (i) T.Kumar, Waste Paper Trader, (ii) Hero Tea Stall, (iii) HPLC Petrol Bank, and (iv) Aavin Milk Booth run by Aavin, have also encroached upon the road.

3. Mr.Arunbabu states that the officials of the Greater Chennai Corporation will not interfere with the functioning of the hotel, but will continue further proceedings under Section 128(1)(B) of the Tamil Nadu Urban Local Bodies Act, 1998. If the petitioner in this case has encroached upon the land belonging and vested with the Municipality, appropriate orders will be passed by the Greater Chennai Corporation. His statement is recorded.
4. If it is found to be an encroachment, it is left open for the authorities, as well as the petitioner, to work out their rights in accordance with law. As long as the licence of the petitioner is valid, his business shall not be interfered with.
