The petitioner, who apprehends arrest for the alleged offence under Sections 3(2)(a), 4(1) and 5(1)(a) of Immoral Traffic (Prevention) Act, 1956 in Cr.No.122 of 2025 on the file of the respondent police seeks anticipatory bail.

2. The allegation against the petitioner is that he, along with the other accused, was running a brothel under the guise of a spa by engaging girls. Hence, the present case.

3. Earlier, this Court, by order dated 16.09.2025 in Crl.O.P. No.25337 of 2025, dismissed the anticipatory bail petition filed by the petitioner for the following reasons:

" Considering the facts and circumstances of the case, nature of allegations, submissions made by the learned counsel on either side, considering the gravity of offence committed by the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner".

4. The learned counsel appearing for the petitioner submitted that now A2 has been arrested and released on bail. Hence, the same may be considered as a change in circumstance, and he prayed that anticipatory bail may be granted to the petitioner.

5. However, on perusal of the earlier order, it is revealed that this 2/4

Court had dismissed the anticipatory bail petition on the ground of the gravity of the offence and the overt acts attributed to the petitioner. Merely because the other accused has been arrested and released on bail cannot be considered a sufficient ground to grant anticipatory bail to the petitioner. Hence, I am not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 24.10.2025 Vv To
