ORDER

The petitioner apprehends arrest at the hands of the respondent police for the alleged offence under Section 309(4) and 351(3) of BNS, 2023 in Crime No.310 of 2025 on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that the petitioner joining 1/4

hands with other accused waylaid and robbed money to the tune of Rs.6,000/- from the defacto complainant. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner has been falsely implicated in this case. He further submitted that he is willing to abide by any stringent conditions that may be imposed by this Court and also ready to cooperate for investigation. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police upon instructions submitted that totally there are three accused in this case and that the petitioner is ranked as A3. He further submitted that the petitioner joined hands with other accused attacked the defacto complainant and caused severe injuries and thereafter taken away Rs.6,000/- from him and so far Rs.520/- has been recovered. He further submitted that A1 and A2 in this case already arrested and still in custody and no previous cases has been registered against him. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Though, it is stated that the petitioner herein is not having any previous cases, investigation in this case is not concluded and out of 2/4

Rs.6,000/- only Rs.520/- has been recovered and arrested accused are still in custody and the petitioner involved in robbery, this Court is of the view that if the petitioner released on anticipatory bail, he will indulge in similar activities. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 22.10.2025 ssi To:
