Respondent Prayer : Petition filed under Article 226 of the Constitution of India seeking a writ of Certiorarified Mandamus to call for the records pertaining to the Order made in Cri.MP.No.3910 of 2025 dated 15.09.2025 passed by the Hon'ble Chief Judicial Magistrate Court at Tiruvallur and to quash the same on the ground of it being arbitrary
exercise of power, violation of principles of natural justice and consequently to declare that the SARFAESI action initiated by the Respondent in respect of the property All that piece and parcel of 195.5 Sq.Feet of Undivided share of land out of 391 Sq.Feet of undivided share of land together with Flat bearing Flat No.F-1 measuring 283.5 Sq.Feet out of 567 Sq.Feet situated at First Floor, bearing Plot No. 143, situated at Santhosh Nagar, Porur Village, Maduravoyal Taluk.

(Order of the Court was made by the Hon'ble Chief Justice) As there is no exceptional ground raised to entertain the writ petition without insisting on exhaustion of alternative remedy to approach the Debts Recovery Tribunal, petition is dismissed with liberty to petitioner to approach Debts Recovery Tribunal. There shall be no order as to costs. W.M.P.No.44989 of 2025 filed seeking to permit petitioners to join together and file single writ petition is
