Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus directing the 2 nd respondent to dispose of the petitioner representation dated 17.01.2022 as the time fixed by this Court and further direct the respondents to issue patta in the name of Sir Arulmigu Raja Muniyappan Temple, in respect of S.No.24/1C and 24/1A at Perumpattam Village, Chengam Taluk, Tiruvannamalai District by cancelling the patta No.625 & 831 granted in the name of the 4 th respondent.

This writ petition has been filed for the issue of a writ of mandamus directing the 2 nd respondent to dispose of the representation made by the petitioner on 17.01.2022, wherein, the petitioner is seeking for issuance of patta in the name of the temple with respect to the subject property, after cancelling the patta which presently stands in the name of the 4 th respondent in patta No.625 & 831.

2. Heard the learned counsel for the petitioner, learned Government Advocate appearing for the respondents 1 to 3 and perused the materials available on record.

3. The case of the petitioner is that the temple is the owner of the subject property, whereas, the 4 th respondent has managed to obtain patta illegally. Therefore, repeated representations were made in this regard by the villagers seeking for cancellation of patta. Ultimately, one of the representations that was sent to the 1 st respondent was forwarded to the 2 nd respondent and an enquiry was also held by the 3 rd respondent in the year 2022. Thereafter, there was absolutely no progress and even the subsequent legal notice and representation did not evoke any response. It is under these circumstances, the present writ petition has been filed.

Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction to the 2 nd respondent to deal with the representation made by the petitioner on 17.01.2022 on its own merits and in accordance with law after affording an opportunity to the th respondent and all other interested persons and pass final orders within a period of eight weeks from the date of receipt of a copy of this order. The writ petition is disposed of with the above direction. No costs. 03.11.2025 gya 3/4
