Prayer:- Writ Petition filed under Article 226 of the Constitution of India praying for a Writ of Habeas Corpus directing the respondents herein to produce the body and person of petitioner's husband, by name Mr.M.Manikandan, aged about 49 years before this Court and set him at liberty.

O R D E R
(Order of the Court was made by N.SATHISH KUMAR, J.) The petitioner is the wife of the detenu, who is stated to be missing from the house on 01.03.2024.
2. It is stated by the petitioner that her husband has availed a housing loan of Rs.18 lakhs from a Bank in the year 2014 and has repaid to the tune of Rs.13,81,072/-. Thereafter, he could not pay the balance loan amount. According to the petitioner, due to the continuous pressure from the Bank 2/6
for repaying the loan amount, her husband was under mental depression and left the home on 01.03.2024.
3. The learned counsel for the petitioner submitted that an online complaint was lodged by the petitioner on 04.03.2024, which was registered in FIR No.89 of 2024 on 06.03.2024, but till date the detenu could not be traced. Hence, the present petition.
4. The learned Additional Public Prosecutor filed a status report. A perusal of the same indicate that the respondent police are taking every effort to trace out the detenu and they have also published a notice in the "Daily Thanthi" newspaper and also distributed pamphlets. The respondent police also made enquiries in the hospitals and Railway stations with the photograph of the detenu, but the detenu could not be traced. It is also seen that the expertise of the Cyber Crime Cell has also been sought .
4. We are of the view that proper enquiry is being conducted by the respondents. Therefore, the respondents are directed to make enquiry with 3/6
regard to unclaimed dead bodies also and if the respondents are able to trace out the detenu, he shall be produced before the jurisdictional Magistrate or a report shall be filed before the jurisdictional Magistrate.
