PRAYER Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Certiorarified Mandamus calling for the records of the 3rd respondent in Na.Ka.D2 / 5142 /2024 dated 28/02/2025 and to quash the same as illegal and consequently to direct the respondent to consider the petitioner for appointment to an appropriate post commensurate with the educational qualifications under compassionate grounds. ORDER

This Writ Petition has been filed challenging the order passed by the 3rd respondent dated 28.02.2025, thereby rejected the request made by the petitioner seeking compassionate appointment.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner is the daughter of Late Narayanan, who was employed as an Office Assistant in the 3rd respondent department and died in harness on 20.01.2009. After the death of her father, the petitioner's mother submitted an application seeking compassionate appointment, which was rejected on the ground of insufficient educational qualifications. Subsequently, the petitioner herself submitted an application for compassionate appointment, which was also rejected.

4. Admittedly, the petitioner's father died on 23.06.2009 and the petitioner submitted her application seeking compassionate appointment after a lapse of 13 years. As per the extant rules, an application for compassionate appointment must be made within a period of three years from the date of death of the Government servant. Therefore, the 3rd respondent has rightly rejected the request made by the petitioner and this Court finds no infirmity or illegality in the order passed by the 3rd respondent dated 28.02.2025. 3/5
