This Writ Petition has been filed challenging the impugned order passed by the second respondent dated 09.07.2025, confirming the order of dismissal passed by the third respondent dated 25.10.2024.
2. Heard the learned counsel for both sides and perused the materials available on record.
3. The petitioner was initially appointed as a Gardener. 2/6
Subsequently, he was promoted to various posts and finally to the post of Accountant (Assistant Position-Government Aided Staff). While he was serving as Accountant, the third respondent issued a charge memo to the petitioner alleging that the petitioner, along with others, had misappropriated a sum of Rs.60,00,000/-. After conducting a due enquiry, the petitioner was dismissed from service. The said order of dismissal was also confirmed by the Appellate Authority.
4. The learned counsel for the petitioner would submit that there were four delinquents of whom two were management staff and two were Government employees. Even the Enquiry Officer had concluded that there was no material to establish the alleged misappropriation of Rs.60,00,000/. However, without considering the said finding, the petitioner was dismissed from service.
5. On perusal of record, it is revealed that both the fact finding authorities had concluded that the petitioner had misappropriated funds to the tune of Rs.60,00,000/-. Even as per the enquiry report, though the exact 3/6
quantum could not be determined, it has been clearly found that the petitioner and another misappropriated a substantial amount. Therefore, the matter does not warrant any further judicial scrutiny unless there is a violation of principles of natural justice, lack of jurisdiction, or any action contrary to law. Hence, this Court finds no infirmity or illegality in the order passed by the second respondent and this Writ Petition is devoid of merits.
6. In the result, this Writ Petition is dismissed. Consequently, the connected Miscellaneous Petitions are closed. No costs. 17.11.2025 Index:Yes/No kv 4/6
