Polytechnic College to the P.T Lee Chengalvaraya Naicker Trust in Pursuance to the letter No.CNT / A1 / 1431 / 25 dated 12.08.2025 issued by the third respondent herein within a time frame to be fixed by this Court.

O R D E R
This writ petition has been filed for direction to the second respondent to approve the migration of the petitioners' services from Bhaktavatsalam Polytechnic College to the third respondent in pursuant to the letter dated 12.08.2025 on the file of the third respondent. 2.
The petitioners are brother and sister. The first petitioner completed M.Sc., B.Ed. and the second petitioner completed ME (Mechanical Engineering). After successful completion of their higher studies, both were selected and appointed as Lecturer (Chemistry) and Lecturer (Mechanical Engineering) during the year 2024 at 2/6
Bhaktavatsalam Polytechnic College Karapettai, Kancheepuram. It is a Government aided institution. Thereafter, they intended to get migrated from the said institution to the third respondent and submitted representations. The representations were considered and consent was given to take the petitioners in the third respondent by the approval of the third respondent committee dated 04.08.2025. Accordingly, the third respondent had sent Board Resolution and consent for migration of the petitioners to their college by approval dated 12.08.2025. The petitioners approached the second respondent to approve the migration of their services from Bhaktavatsalam Polytechnic College to the third respondent. So far no reply has been received by saying one or other reason.

In view of GO.Ms.No.344 Education, Science & Technology Department dated 26.03.1984, the second respondent ought to have approved the migration of the services of the petitioners from one institution to another without seeking any no objection certificate and without any delay. Therefore, there is no necessity to get consent from 3/6
both the institutions. It is sufficient to get consent from the transferee institution. As stated supra, already the third respondent by its resolution dated 04.08.2025 consented for migration of the services of the petitioners and the same was also approved on 12.08.2025. 4.
In view of the above discussion, the second respondent is directed to approve the migration of the petitioners' services form Bhaktavatsalam Polytechnic College to the P.T Lee Chengalvaraya Naicker Trust in pursuant to the approval dated 12.08.2025 on the file of the third respondent within a period of four weeks from the date of receipt of this order.

With the above direction, this writ petition stands disposed of. There shall be no order as to costs.
