Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to revise the petitioner's wages with effect 01.09.2016 based on the 13th wage settlement deed 04.01.2018 and pay him the arrears of wages payable from 01.09.2016 to 30.06.2017, difference in Leave Salary and Gratuity along with the interest at the rate of 12% per annum from the date of entitlement to the date of actual disbursement.

ORDER
This Writ Petition has been filed seeking a direction to the respondents to revise the petitioner's wages with effect from 01.09.2016 based on the 13th Wage Settlement dated 04.01.2018 and consequently pay the difference in gratuity and leave salary along with interest.
2. Heard the learned counsel appearing on either side and perused the materials available on record.

The petitioner joined the services of the first respondent Corporation as Driver on 26.07.1985 and after being promoted to the post of Special Grade Driver, retired from his service on 30.06.2017 on attaining the age of superannuation. He was disbursed retirement benefits on 31.10.2017 & 07.12.2017 respectively. While so, the 13th Tripartite Wage Settlement under Section 12(3) of the Industrial Dispute Act was entered into between the Management and the Trade Unions on 04.01.2018. As per the terms of settlement, 2/4
the management agreed to revise the wages of the employees those who were in service as on 01.09.2016 by revising their pay as (Basic Pay + Grade Pay) x 2.44 of the earlier wages. Since the petitioner had retired from service on 30.06.2017 he was not extended the benefits of the said Wage Settlement. Therefore, the petitioner submitted a representation seeking disbursal of the differential amount towards gratuity and leave salary with interest.

In view of the above, the respondents are directed to revise the wages of the petitioner with effect from 01.09.2016 in terms of the 13th Wage Settlement dated 04.01.2018 and to disburse the differential amount towards gratuity and leave salary, together with interest at the rate of 6% per annum, within a period of twelve weeks from the date of receipt of a copy of this order.
5. With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
