Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to order passed by 2 nd respondent in Ku.No.900/Me.Po/Semipav/The-I/ Ne.Aa./NePi1/U2/Ko. Finalorder/24 dated 15.05.2025 and to quash the order and consequently direct the respondents 1 and 3 to conduct a lawful enquiry as against the 5 th respondent in respect of his unlawful act committed by him. This Writ Petition has been filed challenging the order of punishment issued by the second respondent dated 15.05.2025.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

A perusal of the impugned order passed by the respondent reveals that it is an appealable order before the Chief Engineer, and such appeal has to be filed within a period of ten days from the date of receipt of the order. However, the petitioner has not preferred any appeal and has straightaway approached this Court by filing the present writ petition. When the appeal remedy is very much available, the writ petition is not maintainable and is liable to be dismissed.

4. Considering the above facts and circumstances, the petitioner is at liberty to file an appeal before the Appellate Authority within a period of two 3/7

weeks from the date of receipt of a copy of this order. On receipt of such appeal, the Appellate Authority is directed to consider and dispose of the same, after affording an opportunity of hearing to the petitioner, on merits and in accordance with law, within a period of twelve weeks thereafter.

5. In the result, this Writ Petition stands dismissed with the above direction. Consequently, connected miscellaneous petitions are closed. There shall be no order as to costs.
