This Writ Petition (Criminal) has been filed to direct the 1st to 4th respondents particularly 4th respondent not to interfere in the possession of the petitioners property bearing survey Nos.731/2 to extent of 0.35 acres, 740/4 to extent of 0.41 acres, 742 to extent of 0.80 acres, 730/1 to extent of 0.36 acres, 731/1 to extent of 0.41 acres, 732/5 to extent of 0.19 acres, 727 to extent of 0.85 acres, 741/1 to extent of 0.89 acres, 741/2 to extent of 0.14 acres, 728 to extent of 1.48 acres, 729/1 to extent of 0.75 acres, 730/2 to extent of 0.04 acres, 740/1 to extent of 0.58 acres, 740/2 to extent of 0.29 acres, 740/3 to extent of 0.36 acres, 740/5 to extent of 0.41 acres, 729/2 to extent of 1.00 acres, 743 to extent of 0.36 acres, situated at Vallur Village Ponneri Taluk, Minjur Panchayat Union, Thiruvallur District - 600 103.
2. According to the petitioners, the police are unnecessarily interfering with their possession. The private respondents have already filed a suit before the District Munsif Court, Ponneri in O.S.No.116 of 2025 seeking permanent injunction and that, no injunction has been granted in their favour. Now the matter has been adjourned to 27.10.2025. However, the respondents are interfering with their possession.
3. The learned Additional Public Prosecutor appearing for the respondents police, on instructions submitted that the police will not 3/6
interfere with the possession of any one unless there is law and order issue. The same is recorded.
4. It is made clear that as long as a dispute is in respect of a civil right, the police have no right to interfere except if any criminal offence is committed.
5. With the above observations, this Writ Petition is disposed of. Consequently, the connected Miscellaneous Petition is closed. 17.10.2025 ksa-2 Index:Yes/No Speaking/Non-speaking order 4/6
