When the matter is taken up for hearing, it is represented by the learned counsel for the Petitioner that the first respondent is no more and that the writ petition may be ordered with liberty to the legalheis of the 1st respondent to reopen the matter, if so desired.
2. In view of the above submission, without going into the merits of the matter the writ petition is ordered and the impugned award is set aside. Since the Workman is stated to be dead, the Industrial Dispute itself stands abated. If the legal heirs of the 1st respondent are interested in pursuing the matter, they are entitled to file a petition to reopen the https://hcservices.ecourts.gov.in/hcservices/
matter and in such an event the matter will be reopened, heard on merits and thereafter, suitable orders will be passed. No costs. Consequently connected miscellaneous petition is also closed.
