ORDER
This Writ Petition is filed seeking direction to the respondents 1 & 2 to consider the representation of the petitioner dated 13.01.2025 and to implement and disburse the wage arrears due to the petitioner in pursuance to the order dated 02.10.2023 passed by the 2 nd respondent to the bank account of the petitioner bearing name John Mary and bearing A/c.No.35182233108 maintained with State Bank of India-Cuddalore OT Branch.
2. Mr.C.Selvaraj, learned Standing counsel takes notice for the first and second respondents. M/s.M.Jayanthy, learned Additional Government Pleader, takes notice for the third respondent.
3. The brief facts of the case are that the petitioner (Mary @ John Mary), a daily wage sweeper with over 15 years of service under the 2 nd respondent, was entitled to permanent status under the Tamil Nadu Industrial Establishments (Conferment of Permanent Status to Workmen) Act, 1981. The Authority under above said Act, passed an order dated 11.07.2012, directing the respondents to confer permanent status with monetary benefits from 01.01.2006, which was upheld by this Court in W.P.No.13051 of 2013 and WA.No.255 of 2019. After Contempt Proceedings, the second respondent issued an order dated 02.10.2023, conferring permanent status, but withheld the petitioner's arrears due to a name discrepancy. Therefore, the petitioner has made a representation before the first and second respondents on 13.01.2025, seeking disbursal of the arrears and the same is pending without any action. Hence, the petitioner has preferred this Writ Petition, with the above said prayer.
4. Learned counsel appearing for the respondents submits that petitioner's representation will be considered and the same would be disposed
of within a period of four weeks.
5. Recording the said submission, this Court directs the first and second respondents to consider the representation of the petitioner dated 13.01.2025 and dispose of the same by passing appropriate orders on merits and in accordance with law, within a period for four weeks from the date of receipt of copy of this order.
6. With the above said directions, this Writ Petition is disposed of. No costs.
