PRAYER : Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing the respondents 2 and 3 to issue a fresh notice to the petitioner in accordance with the order dated 16.12.2024 made in Letter No.5523/UD-VII(1)/2017-6 passed by the 1st respondent and consequently direct the respondents 2 and 3 to de-seal the 2nd floor of the petitioner's property bearing Plot No.9, Door No.9/5, Loco Works Scheme Road, Agaram, Chennai 600 082 so as to enable the petitioner carry out the direction issued by the 1st respondent.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) Heard learned counsel for the parties.

2. The grievance, as set out in the writ petition, is that the respondent authorities are not taking steps as per the order dated

18.12.2024 passed by the revisional authority in proceedings under Section 80A of the Tamil Nadu Town and Country Planning Act, 1971.

3. If that be so, the petitioner should have approached the revisional authority by submitting appropriate application stating that the order is not being complied with. Even now this can be done.

4. The writ petition is closed with liberty to approach the revisional authority bringing to its notice the allegation as levelled in this petition, whereupon the revisional authority shall take appropriate steps in the matter, after making due enquiry on factual aspects.
