ORDER
This Petition filed seeking for issuance of a Mandamus, to direct the first respondent to constitute a Special Investigation Team (SIT) to look into the allegations by considering the representation of the petitioner dated 09.10.2025, in accordance with law.
2.The petitioner was alloted natham patta in S.No.224/4 and over a period of 75 years, the petitioner enjoying the property by putting up a thatched house
and residing there. In the year 1995, the Thahsildar, Tittakudi issued patta no.438 in the name of the petitioner. On 04.02.2024, the petitioner had settled the property by way of a Will to his son, Thiru Arulmurugan. The same is by way of a registered document in SRO, Tholudur. While so, after a period of 30 years, one E.Kasiammal, W/o.Ramaswamy, given a petition to cancel the patta issued to the petitioner. On 11.06.2025, a notice was issued for enquiry. Even prior to it, on 10.06.2025, the petitioner filed a petition before the Tahsildar in this regard. The petitioner also filed a writ petition in WP No.25525 of 2025 and this Court by order dated 04.09.2025, directed the concerned officials to issue notice to the petitioner and thereafter, to take a decision with regard to the claim of Kasiammal, and the order uploaded on 04.09.
2025 at about 4.52 pm, but the Tahsildar, Vridhachalam and the RDO not considered the order of this Court, by taking a bribe of Rs.2 lakhs through mediator, have cancelled the patta no.438 of the petitioner, instead issued a new patta no.757 to Kasiammal. Hence, according to the petitioner, it is a fit case of corruption and hence, he sent a complaint, but so far, no action has been taken. 3.The learned Public Prosecutor filed a Status Report of the Deputy Superintendent of Police, Vigilance and Anti-Corruption, Headquarter, 2nd respondent herein, wherein and paragraph nos.
"5. I respectfully submit that, after receipt of the petition sent by the petitioner to the Directorate of Vigilance and AntiCorruption, Chennai separate Petition number 13745/2025/REV/CL, Dt.13.10.2025 was assigned and Factual Verification was done as per the guidelines in G.O. (Ms). No.173, P & AR (N) department, dated 19.12.2018. During the course of factual verification it was ascertained that the patta was transferred as per Court Order and there is no evidences to prove the bribe allegation. In the above said petition was sent to the Principal Secretary/Commissioner for Revenue Administration, Ezhilagam, Chennai-5 vide letter circumstances the in Petn.No.13745/2025/REV/CL, Dt.04.11.2025 of the DVAC, for taking necessary action who is in a better position to make proper disposal of the petition by scrutinizing the relevant documents available in the department.
6. I respectfully submit that, the petitioner Thiru. Periyasamy was informed that his petition was forwarded to the Principal Secretary/Commissioner for Revenue Administration, Ezhilagam, Chennai-5 for disposal of the petition vide letter in Petn No. 13745/2025/REV/CL, Dt.04.11.2025 on the same day."
4. From the above, it appears that the 2nd respondent has forwarded Petn. No.13745/2025/REV/CL, Dt.04.11.2025 to the Principal Secretary/Commissioner for Revenue Administration for taking further action.
Since the allegation of bribe seems to be sweeping and bald one, the report of the Principal Secretary/Commissioner for Revenue Administration is awaited and if the allegation of bribe and corruption is found, appropriate action would be taken.
5.In view of the above, this Court directs the Principal Secretary/Commissioner of Revenue Administration, Ezhilagam, Chennai-5 to consider the Petn.No.13745/2025/REV/CL, dated 04.11.2025, forwarded by the 2nd respondent herein and dispose of the same, based on the outcome of the enquiry, the 1st respondent to take further action if required, within a period of eight weeks from the date of receipt of the a copy of this order. 6.Accordingly, this Petition is disposed of.
