ORDER
This Writ Petition has been filed for direction directing the respondents 3 & 4 herein to provide adequate police protection to the surveyor to survey the petitioner's land and to install the survey stones indicating the boundaries of the said survey numbers in accordance to the grant of Patta in the name of petitioner.
2.
The petitioner owned a land comprised in Survey No.222A/7 measuring a total extent of 0.08 cents situated at Pakkam Village, Vanapuram Taluk, Kallakuruchi District. In order to survey the said land, the petitioner submitted an application before the fifth respondent and also paid requisite fees for the same. On receipt of the said request, the fifth respondent engaged the respondents 6 & 7 to survey the petitioner's land. However, the respondents 8 to 11 objected to survey the land in the light of the pendency of the civil suits. Therefore, the fifth respondent sought for adequate police protection to the fourth respondent to his
surveyor while surveying the petitioner's property. 3.
The learned counsel appearing for the respondents 8, 10 & 11 submitted that already the petitioner applied for cancellation of sub division of the subject property and filed Writ Petition before this Court in W.P.No.12284 of 2025. This Court by an order dated 16.04.2025 directed the Revenue Divisional Officer, Kallakurichi, to conduct enquiry. As directed by this Court, the Revenue Divisional Officer issued summons to the petitioner as well as the respondents 8 to 10 and the enquiry is pending. Therefore, the subject property cannot be surveyed and as such the respondents 8 to 11 raised the objection. 4.
Heard the learned counsel appearing on either side and perused the materials placed before this Court. 5.
On perusal of the records, it is revealed that the request made in W.P.No.12284 of 2025 and the present request made by the petitioner are entirely different and no way connected to each other. Though the property is one and the same, now the petitioner filed the application to survey his land. It was considered by the fifth respondent and instructed the respondent 6 & 7 to survey the petitioner's land.
6.
In view of the above, the fourth respondent is directed to conduct enquiry and pass order to provide adequate police protection to the respondents 6 & 7 to survey the petitioner's land, within a period of two weeks from the date of receipt of a copy of this order. 7.
With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
