ORDER

This Criminal Original Petition has been filed seeking a direction to the learned Principal District and Sessions Court, Chengalpattu to accept the surrender of the petitioners herein concerned in Crime No.202 of 2025, on the file of the respondent police and consider the bail petition on the same day itself.

2. The learned counsel for the petitioners would submit that the charge sheet has now been filed and the name of the second petitioner has been dropped. Hence, he is not pressing the petition insofar as the second petitioner is concerned, and he has also made an endorsement to that effect in the petition. 2/5

3. The learned Government Advocate (crl.side) appearing for the respondents 1 and 2 would also submit that final report has been filed on 23.10.2025, in which the second petitioner herein has not been arrayed as an accused.

4. In view of the specific bar under Section 18 of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 and also taking into consideration the possibility of misusing the pious intention of the Parliament against innocent persons, there shall be a direction to the learned Principal District and Sessions Court, Chengalpattu to consider the first petitioner's bail application, preferably on the same day of his surrender in connection with Crime No.202 of 2025 on the file of the second respondent and pass appropriate orders in accordance with law, after affording due opportunity to the victims under Section 15-A of the SC/ST (POA) Act, 1989. The first petitioner shall surrender before the concerned Jurisdictional Court, within a period of fifteen days from the date of receipt of a copy of this order. 3/5

5. In view of the above, the Criminal Original Petition stands allowed in respect of the first petitioner and this petition is dismissed as not pressed insofar as the second petitioner is concerned.
