O R D E R

(Order of the Court was made by S.M.SUBRAMANIAM, J.) The Present Contempt Petition has been instituted to punish the respondents for their wilful disobedience of the orders of this Court dated 18.04.2025 passed in W.P.No.10584 of 2024.

2. This Court passed the following orders:-

3. The Committee will have to issue notice to the alleged encroachers and solicit their reply. The petitioner cannot seek such an early disposal of the representation/ application. If the said representation/ application is not decided within a reasonable time, i.e., within six months from today, then the petitioner may agitate.

3. Pursuant to the directions issued by this Court, the process of enquiry has been undertaken by the competent Revenue Authority. The District Revenue Officer, Tiruvannamalai passed an order in proceedings dated 04.11.2024 stating that there is no water body that exists as per the revenue records and that apart patta has been granted in respect of "Natham" land. The District Revenue Officer has further stated that if there is any encroachments in the Government Poramboke land other than the land for which patta has been issued, the Tahsildar is directed to take enforcement action to remove the encroachments.

4. The learned Special Government Pleader would submit that again survey was conducted and encroachments are identified.

5. The Tahsildar is bound to initiate appropriate actions to remove the encroachments in the Government Poramboke land by invoking the provisions of the Tamil Nadu Land Encroachment Act. The petitioner is at liberty to pursue the matter with the Tahsildar for eviction of encroachers from the Government Poramboke lands.

6. At the outset, the final decision of the District Revenue Officer would be sufficient to form an opinion that there is no disobedience of the orders of this Court.
