ORDER

(Order of the Court was made by the Hon'ble Chief Justice) In response to the allegation that while allowing the temple authorities to raise ceiling in the existing temple, the authorities are also allowing the temple authorities to cut or partly remove the existing banyan tree, adjacent to the temple building, learned counsel for the respondents, upon instructions, would submit that permission has been granted to the Executive Officer of the Temple to raise the ceiling, without allowing anyone to cut, or in any manner remove, or disturb the existing banyan tree.

2. By way of abundant caution, we are inclined to direct the second respondent to ensure that while raising any construction in and around the temple, it shall be ensured that the banyan tree is not allowed to be cut or in any way damaged.

3. With the above said observation, the petition stands disposed of. There will be no order as to costs.
