ORDER

This application is filed to grant leave to the applicants/plaintiffs to sue against the 7th and 8th defendants and to sue in respect of the subject matter of the properties situated outside the jurisdiction of this Court. Page No.1 of 3

2. According to the applicants/plaintiffs, they filed the main Suit for the relief of the partition and separate possession of the schedule mentioned properties. The 7th and 8th defendants are residing outside the jurisdiction of this Court and item Nos.2 to 5 of the schedule mentioned properties are situated outside the jurisdiction of this Court. Therefore, they filed this application.

3. Considering the reasons stated in the affidavit, the nature of relief sought for in the main suit, some of the properties being situated outside the jurisdiction of this Court, the 7th and 8th defendants also residing outside the jurisdiction of this Court and the substantial part of the cause of action arose within the jurisdiction of this Court, this application is allowed. Leave is granted.

4. The Registry is directed to number the Civil Suit, if it is otherwise in order.
