Respondents Prayer: Petition filed under Article 226 of the Constitution of India, to call for the records relating to the order of the first respondent in Na.Ka.No.1060/95/Kanimam-D dated 05.12.2003 and quash the same and consequently direct the respondents to continue to issue the petitioner the transport slips /permits for carrying on with the quarrying operations in Survey No.179 of Meenakshipuram Village, Madurai North Taluk, measuring an extent of 6.90.0 hectares by the issue of a Writ Certiorarified Mandamus.

In this writ petition, the petitioner has challenged the order in Na.Ka.No.1060/95/Kanimam-D dated 05.12.2003 passed by the District Collector and has also sought for a direction to the respondents to continue to issue the petitioner the transport slips /permits for carrying on with the quarrying operations in Survey No.179 of Meenakshipuram Village, Madurai North Taluk, measuring an extent of 6.90.0 hectares. An interim order staying the impugned order had been granted by this Court on 31.12.2003 in W.P.M.P. No.47459 of 2003.

2. The learned counsel for the petitioner has submitted that the writ petition may be dismissed as not pressed and has also made an endorsement to that effect.

3. Recording the same, the writ petition is dismissed as not pressed and the order of interim stay granted by this Court stands vacated. Accordingly, connected miscellaneous petitions are closed. No costs.
