ORDER
This Writ Petition has been filed by the petitioners seeking a Writ of Certiorarified Mandamus, to call for the records pertaining to the Impugned work order issued by the 3rd respondent dated 17.09.2025 for hiring of additional lorries under the Tender Notification Vide No.MAT/OT/006/2024-2025 dated 09.08.2024 and quash the same as arbitrary, illegal and ultra vires and consequently direct the respondents 1 to 3 to consider the petitioners willingness through representation dated 30.08.2025 and issue work order as per Section - III (I)(2) of the Tender Notification vide No.MAT/OT/006/2024- 2025 dated 09.08.2024 floated by the respondents 1 to 3. 2. Since no adverse order is being passed against the respondents, notice to the respondents is dispensed with.
3. The 1st petitioner has took part in the tender floated by the respondents for supply of water to the public in and around Chennai. According to the 1st petitioner, she was one of the successful bidders along with many others, who were given a job of supplying water through their lorries. She has made a avernment that some of the lorry owners have formed a syndicate choosing their own Secretary, President and other office bearers and they were literally threatening and blackmailing the respondents and keeping the entire supply of water in the Chennai City in their own hands. Though she has raised many grievance, the respondents have not taken any action against the said syndicate.
4. While that being so, the respondents have issued fresh tender notification for hiring additional lorries for supply of water. According to the petitioners, there is absolutely no transparency in the award of tender and even though the petitioners and other successful bidders are willing to supply extra loads of water, they were not preferred. According to them, fresh tender issued for hiring additional lorries for supply of water is totally unwarranted. In this Page No.3 of 7
regard, the petitioners have drawn the attention of this Court to an earlier order passed by this Court in a writ petition filed by one of the lorry owners, in W.P.No.26086 of 2025, wherein a similar prayer was made. In the said writ petition, the respondents given an undertaking before this Court that they are maintaining a seniority list and the persons have been chosen only from the seniority list and there is no indiscriminate engagement of vehicles apart from those persons whose names are mentioned in the seniority list. Recording the said undertaking, the said writ petition was disposed of with liberty to the petitioner therein to approach this Court, if the respondents are engaged in any vehicle indiscriminately without following the seniority list.
5. Heard the learned counsel appearing for the petitioner and also perused the materials available on record.
6. The 1st petitioner herself being one of the successful bidders is not justified in challenging the subsequent tender notification. Moreover, the earlier writ petition filed for a similar relief was disposed of by this Court based on the undertaking given by the respondents that they would not indiscriminately hire outsiders and engagement of vehicles would be made only from the seniority list. 7. Therefore, this Court is not inclined to grant any relief as sought for by the petitioners. Accordingly, the Writ Petition is dismissed. However, the respondents are directed to give a copy of the seniority list to the petitioner, within a period of two (2) weeks from the date of receipt of a copy of this order. The respondents are also directed to strictly adhere to the undertaken given before this Court in W.P.No.26086 of 2025, wherein they have stated that engagement of additional lorries would be made only as per the seniority list. No costs.
