O R D E R

The petitioners, who were arrested and remanded to judicial custody on 08.10.2025 for the alleged offence under Sections 296(b), 115(2), 311 1/4

and 351(3) of BNS in Crime No.1103 of 2023 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioners were waylaid the defacto complainant, attacked him and robbed a sum of Rs.450/- from him at knife point. Hence, the case.

3. The learned counsel appearing for the petitioners submitted that the petitioners have been falsely implicated in this case due to their bad antecedents and they are in judicial custody from 08.10.2025. He further submitted that the petitioners are ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioners.

The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and reported that the petitioners are having bad antecedents and the first petitioner is having seven previous cases including two murder cases and he is also a History Sheeter vide H.S.No.14 of 2014. Further, the other two petitioners have also 2/4

involved in two other cases, which includes murder. Hence, he opposed to grant bail to the petitioners.

5. Heard both sides and perused the materials available on record.

6. Considering the fact that the petitioners are having bad antecedents and they have arrested recently, Further, if the petitioners are released on bail, they shall commit the same offence repeatedly,. Hence, I am not inclined to grant bail to this petitioners.

7. Accordingly, this Criminal Original Petition is dismissed. 25.10.2025 Vv To
