ORDER

This petition has been filed seeking a direction to the Punjab National Bank, rep. by its Authorized officer, the respondent herein to consider the

representation dated 11.08.2025 made by the petitioner for return of all the original parent document pertaining to the property sold in auction along with the cancelled Memorandum of Deposit of Title Deeds to the petitioner.

It is the case of the petitioner that the petitioner is a purchaser of the schedule property in the private treaty sale conducted by the respondent bank on 22.02.2018 under the provisions of the securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002. The petitioner has paid the entire sale consideration of Rs.43,00,000/- The respondent bank has confirmed the sale and issued a sale certificate to the petitioner on 26.02.2018. Despite several visits to the office of the respondent and oral requests for the return of the said parent documents along with cancelled memorandum of deposit of the title deeds, the documents were not given. Therefore, the petitioner made a representation on 11.08.2025 requesting the cancellation of the mortgage and the return of all original parent documents. However, the same has not considered so far. Hence, the present writ petition.

3. The learned counsel for the petitioner submitted that this Court may direct the respondents to consider and pass orders on the petitioners representation within the stipulated time as fixed by this Court.

4. Heard the learned counsel for the petitioner and perused the materials

available on record. Since no adverse order is passed against the respondent, notice to the respondent is dispensed with.

5. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the respondent to consider and pass orders on the petitioner's representation dated 11.08.2025 within a period of four weeks from the date of receipt of a copy of this order.
