ORDER
(The Order of the Court was made by P.Velmurugan, J) This Habeas Corpus Petition has been filed to call for the records in connection with the detention order dated 10.07.2025 in Cr.M.P.No.57/Goonda/2025 on the file of the second respondent herein against petitioner's brother Sabarinathan @ Rakki, S/o.Saravanan age 22 years, who is confined in Central Prison, Coimabtore and set aside the detention order and direct the respondents to produce him before this Court and set him at liberty on the grounds that the booklet was served to the detenu with delay of one day and some of the pages in the booklet are not legible.
2. A perusal of records shows that the booklet has been served to the detenu with delay of one day and that there is no proper explanation for the same. Further, some of the pages in the booklet served to the detenu viz., Page Nos.82, 84, 85 and 86 are not legible and thereby the detenu has been deprived of giving a fair representation. Therefore, this Court is inclined to quash the detention order. 2 / 5
3. Accordingly, the order of detention dated 10.07.2025 in Cr.M.P.No.57/Goonda/2025 passed by the second respondent against the detenu namely Sabarinathan @ Rakki, S/o.Saravanan, aged 22 years, is hereby quashed.
4. The detenu namely Sabarinathan @ Rakki, S/o.Saravanan, is directed to be set at liberty forthwith, unless he is required in connection with any other case.
