O R D E R

The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 316(2), 316(5), 318(4) r/w 62 of BNSS and Section 3, 5, 21(1) and 23 of the Banning of Unregulated 1/4

Deposit Schemes Act and Section 5 of TNPID Act in Crime No.4 of 2025, on the file of the respondent Police, seeks anticipatory bail.

The case of the prosecution is that the petitioner along with other accused conspired to defraud the gullible public at the premise of huge returns, induced them to invest in the accused company to get huge income. The petitioner is one of the team leaders and had directly involved in collecting deposits from the public and he is also an Additional Director of the said company. The said occurrence has taken place on 04.09.2023 to 22.02.2025. Hence the case.

The learned counsel appearing for the petitioner submitted that in this case A1 to A4 were already granted bail by this Court and this petitioner ranked as A6 and he is in custody from 04.09.2025 and he is ready and willing to abide by the condition, if any, to be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that A1 to 2/4

A4 were granted bail. The allegation levelled against them is cheating to the tune of Rs.3 crores and subsequently 265 complaints came to be registered totalling to Rs.8.04 crores and the same is under investigation. Further, that the petitioner is also the Additional Director in the said Company. A separate petition was filed for cancellation bail granted to A1 to A4.

4. Considering the grevious nature of offence committed by the accused herein, so far 265 complaints filed to the tune of Rs.8.04 crores, this Court is not inclined to grant of anticipatory bail to the petitioner.
