Respondent(s) PRAYER:-Writ Petition filed under Article 226 of the Constitution of India, praying for an issuance of Writ of Certiorarified Mandamus, calling for the records pertaining to the Refusal Check Slip bearing No.2/2/2025 dated 15.04.2025 issued by the 2nd respondent and to direct the 2nd respondent to register and release the sale deed bearing document number P.No.9/25 dated 09.01.2025 presented for registration on 24.01.2025 before the 2nd respondent within the stipulated time fixed by this Court.

ORDER
Challenging the impugned refusal check slip dated 15.04.2025, issued by the 2nd respondent, the present writ petition is filed. 2.Learned counsel for the petitioner would submit that the petitioner executed a sale deed in favour of one I.Elangovan to sell half of her property viz., acre 0.08 cents out of the total extent of acre 0.16 cents at Katrambakkam Village and presented the same before the 2nd respondent for registration on 24.01.2025. However, the 2nd respondent kept the document pending for a long time and issued the impugned refusal check slip dated 15.04.2025 on the ground that the Tahsildar vide his letter dated 2370/2024/A1 dated 24.12.2024 has expressed objection for registering any transactions with regard to the subject property. Hence, the present writ petition has been filed. 3.
Learned Additional Government Pleader appearing for the respondents would fairly submit that no enquiry was conducted in the present case and therefore, the enquiry will be conducted and thereafter, a decision will be taken by the 2nd respondent regarding the registration of the sale deed presented by the petitioner on 24.01.2025, at the earliest point of time.
4.Heard the learned counsel for the petitioner as well as the learned Additional Government Pleader appearing for the respondents and perused the materials available on record.
5.Considering the submissions made by either parties, it is evident that, in the present case, without conducting any enquiry, the 2nd respondent has issued the impugned refusal check slip dated 15.04.2025. Therefore, this Court feels that it would be appropriate to direct the 2nd respondent to conduct enquiry regarding the objections raised by the Tahsildar vide letter dated 24.12.2024, after issuing notice to all the parties concerned and to take a decision regarding the registration of sale deed presented by the petitioner on 24.01.2025. 6.Accordingly, the impugned refusal check slip dated 15.04.2025 is hereby set aside. While setting aside the impugned refusal check slip dated 15.04.2025, this Court directs the petitioner to re-present the sale deed executed in favour of one I.Elangovan before the 2nd respondent.
Upon such representation, the 2nd respondent is directed to conduct enquiry regarding the objections raised by the Tahsildar vide letter dated 24.12.2024, after issuing notice to all the parties concerned and thereafter, the 2nd respondent is directed to take a decision regarding the registration of sale deed dated 24.01.2025.
