Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondents to revoke the suspension order dated 17.02.2025 passed by the 4th Respondent in his proceedings in No.104/NiA/NiMe/NiPi.3/U.1/Ko.Tha.Pa.Nee/2025 and reinstate the petitioner in service by considering the representation of the petitioner dated 15.09.2025 within a time frame fixed by this Hon'ble Court. ORDER

This writ petition has been filed challenging the order of suspension passed by the fourth respondent dated 17.02.2025.

2. Heard the learned counsel on either side and perused the materials available on record.

3. The petitioner was appointed as an Assistant Engineer. While he was working as an Assistant Engineer, he was placed under suspension. On 15.02.2025, the Vigilance and Anti-Corruption Cell, Krishnagiri district conducted a search in the Assistant Engineer office and arrested the petitioner on the allegation that he had received a sum of Rs.30,000/- as illegal gratification from a consumer. Pursuant to the arrest of the petitioner in Crime

No.02/AC/2025, on the file of the Vigilance and Anti-Corruption Cell, Krishnagiri, the investigation is still pending.

4. In these circumstances, if the order of suspension is revoked, it would cause serious prejudice for the Investigating Officer. When the petitioner is involved in a corruption case and has been caught red-handed while receiving a bribe of Rs.30,000/-, he cannot be reinstated once again into service at this stage.

In view of the above, this Court finds no infirmity or illegality in the order dated 17.02.2025 passed by the 4th Respondent in his proceedings in No.104/NiA/NiMe/NiPi.3/U.1/Ko.Tha.Pa.Nee/2025 and the writ petition is devoid of merits and is liable to be dismissed. Accordingly, this writ petition stands dismissed. No costs.
