B.Rajasingh Gauthaman v. Pooja Premraj
IN THE HIGH COURT OF JUDICATURE AT MADRAS
DATED : 24-11-2025
CORAM
THE HONOURABLE MR. JUSTICE S. SOUNTHAR B.Rajasingh Gauthaman ... Petitioner Vs.
Pooja Premraj ... Respondent PRAYER: This Civil Revision Petition is filed under Article 227 of the Constitution of India to set aside the order dated 19.06.2025 passed in OP No.576 of 2023 by the II Additional Family Court, Chennai and direct the II Additional Family Court, Chennai to conduct a joint trial of O.P.No.576 of 2023 and O.P.No.3655 of 2024 and dispose of both matters by a common judgment. For Petitioner : Mr.A.Arulmozhi
ORDER
This Civil Revision Petition is filed challenging the order passed by the learned II Additional Judge, Family Court, Chennai and also for direction to the trial court to conduct joint trial of O.P.No.576 of 2023 and O.P.No.3655 of 2024.

2. It is not in dispute that the respondent/wife filed a petition in OP No.576 of 2023 seeking divorce. The trial in the said petition was already commenced and PW1 was partly cross examined. At this stage, the petitioner herein filed a separate divorce petition in O.P.No.3655 of 2024. Thereafter, the petitioner submitted a memo seeking joint trial of both the original petitions. In view of the fact that in the said O.P.No.576 of 2023 filed by the respondent/ wife, PW1 was cross examined in part as early as on 27.06.2024 and the present divorce petition by the petitioner/husband in OP No.3655 of 2024 was filed only on 19.08.2025, the Trial Court rightly passed the order for simultaneous trial of both original petitions. When the divorce petition filed by the respondent/wife is in part heard stage, the request made by the petitioner seeking joint trial of both original petitions is not possible. Therefore, I do not find any error in the impugned order passed by the Trial Court.
3. Accordingly, this civil revision petition is dismissed. There shall be no order as to costs.
