Respondents Prayer :- Writ Petition filed under Article 226 of Constitution of India for the issuance of Writ of Mandamus, directing to the 1 st respondent to consider the petitioner's Representation dated 24.09.2024 and consequently include the petitioner in the selection process on the basis of certificate verification in the year 2014, recruitment being made on the basis of TET marks and TET passed year seniority without resorting to any competitive examination as stated in G.O.Ms.No.149, dated 20.07.2018, as a measure of quality and fairness, as well as on foundation of the doctrine of promissory estoppel and legitimate expectation. ORDER
This writ petition has been filed for direction directing the first respondent to consider the petitioner's representation dated
24.09.2024, to include the petitioner's name in the selection process on the basis of certificate verification in the year 2014, without insisting any competitive examination as issued in G.O.Ms.No.149, dated 20.07.2018.
2. Heard the learned counsel appearing on either side and perused the materials available on record.
3. A perusal of records reveals that G.O.Ms.No.149, dated 20.07.2018 has been issued by the School Education Department, thereby ordering that earlier methods are now done away and that a competitive examination has to be held for eligible candidates for selection to the post of Secondary Grade Teachers and BT Assistants. The said Government Order has already been challenged before this Court in W.P.No.161 of 2024 and this Court, by an order dated 08.01.2024, dismissed the above said writ petition, and upheld the said Government Order in G.O.Ms.No.149 dated 20.07.2018 and it was also confirmed by the Hon'ble Supreme Court of India.
4. Now, the petitioner submitted a representation seeking relief to consider the petitioner in the selection process without resorting any competitive examination and the said request was not considered. Hence, this writ petition.
5. In view of the above, the relief sought for in this writ petition cannot be considered. Thus, the writ petition is devoid of merits and is liable to be dismissed. Accordingly, this writ petition stands dismissed. No costs.
