ORDER

The petitioner, who was arrested and remanded to judicial custody on 26.09.2025, for the offences punishable under Sections 8(c), 20(b)(ii)(B) of NDPS Act in Crime No.381 of 2025, registered on the file of the respondent police, seeks bail.

The case of the prosecution is that on 26.09.2025, based on a secret information, the respondent police went to the spot and found that the petitioner was in illegal possession of 1.200 kilograms of ganja in the form of dried stem, leaves, buds. Hence, this case. 3.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in judicial custody since 26.09.2025. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and submitted that the petitioner has four previous cases, 2/4

out of which, three cases are under NDPS Act; and that the investigation is not concluded.

Considering the facts of this case, the previous antecedents of the petitioner, if the petitioner is enlarged on bail, he will indulge in similar offence and taking note of the fact that the investigation is not concluded, this Court is not inclined to grant bail to the petitioner. 6.
